1. Agreement
These Terms of Use govern your use of KantiNotes: the app, the web app at kantinotes-app.web.app and this website (together, "KantiNotes"). KantiNotes is run privately by Arnavdeep Singh and Ennio Massoni, Switzerland ("we", "us"). It is not affiliated with, endorsed by or run on behalf of Kantonsschule Solothurn or any other school.
By creating an account or using KantiNotes, you accept these terms and our Privacy Policy. If you do not accept them, do not use KantiNotes.
2. Who may use KantiNotes
- You must be at least 14 years old. By creating an account, you confirm that you are. We delete accounts that we learn belong to someone younger than 14.
- You can accept these terms yourself. KantiNotes is free of charge, and we treat anyone aged 14 or over as capable of judgement for the purpose of using it, so you do not need your parents' or guardians' consent to create an account or to accept these terms. If you are under 18, we still recommend that you read them together with a parent or guardian.
- You may have one account, which is for you alone. The information you give us must be true, and you must keep your password secret. You are responsible for everything done with your account.
- You may not create a new account after we have suspended or closed yours.
3. The service
KantiNotes is currently free. In the future we may introduce paid features or subscriptions, show advertising, or charge for parts of the service. We will tell you before anything you already use starts to cost money, and we will never charge you without your explicit agreement.
We may change, add or remove features, limit how it can be used, or suspend or discontinue all or part of it at any time, with or without notice. We do not promise that KantiNotes will always be available, fast or free of errors. It may be slow to respond, especially after a quiet period.
4. Your content
You keep ownership of the notes, files, questions, answers, comments and messages you post ("your content").
Licence to us. By posting content, you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, copy, adapt (for example, by making preview images or converting formats), publish, display and distribute your content, for running, providing, improving and promoting KantiNotes. This includes using your content commercially, for example by showing advertising alongside it or by including it in paid features, without paying you. This licence lasts as long as your content is on KantiNotes and ends when you delete the content or your account, except for:
- copies other users have already downloaded or received in messages;
- copies kept in backups for a limited time;
- copies we need to keep for moderation, to comply with the law, or to establish or defend legal claims.
Your promises. For everything you post, you confirm that:
- it is your own work, or you have every right needed to share it on KantiNotes and to grant the licence above;
- it is not a past exam, test or other material written by a teacher or school;
- you have removed other people's names, grades and other personal details;
- it does not break the law or anyone's rights, including copyright and privacy.
You are solely responsible for your content. We do not check content before it is published.
5. Rules
You may not:
- upload material you did not create yourself or have no right to share, including past exams, tests and other material written by teachers or schools;
- upload copies or transcriptions of textbooks or other published works, or diagrams copied from them, beyond what the law allows;
- upload notes or files that contain other people's names, grades or other personal details;
- harass, bully, threaten, insult or impersonate anyone, including in direct and group messages;
- post sexual, violent, hateful, discriminatory or otherwise illegal content;
- share someone else's private information without their permission;
- use KantiNotes to advertise, sell or promote anything, or to send spam;
- sell, transfer or share your account;
- get around a block, mute or suspension, or another user's privacy settings;
- collect data from KantiNotes by automated means (scraping, bots), or create accounts automatically;
- interfere with, overload, probe or attack KantiNotes or its security, or reverse engineer the app except where the law allows;
- upload viruses or other harmful code;
- submit false reports.
6. Reporting, moderation and takedown
Notes, questions, comments and messages can be reported from within the app. We are not obliged to monitor KantiNotes, but we may, at our sole discretion and with or without notice:
- review, hide or remove any content;
- mute an account (it can read but not post) or suspend it;
- close an account, including accounts that repeatedly upload material they have no right to share.
If we restrict your account, you can appeal from within the app.
Copyright and personal data notices. If you believe content on KantiNotes infringes your copyright or contains your personal data without your agreement, email us (section 17) with a link to or description of the content, what right it infringes, and how we can reach you. We act on valid notices promptly and keep a record of what was removed and why. We may forward a notice to the person who posted the content.
7. Notes are written by students
Notes, summaries, questions, answers and comments on KantiNotes are written by other students. We do not check them for accuracy or completeness. Use them to support your own studying, not to replace the material your teachers give you. You are responsible for following your school's rules on what you may use, for example in tests.
8. Our rights in KantiNotes
The KantiNotes name, logo, app, website, design and code belong to us. You may use KantiNotes for your own, non-commercial studying. You may not copy, modify or redistribute the app or website, or use our name or logo, without our written permission. This does not affect your rights in your own content.
9. Other services and links
Signing in with Google is subject to Google's own terms. Content on KantiNotes may link to other websites. We do not control other services or websites and are not responsible for them.
10. No warranties
KantiNotes is provided "as is" and "as available". To the fullest extent permitted by law, we give no guarantees or warranties of any kind: not that KantiNotes will be available, secure or free of errors, not that content on it is accurate, complete or lawful, and not that it is suitable for any purpose. You use KantiNotes at your own risk.
11. Liability
To the fullest extent permitted by law, we exclude all liability for any damage or loss arising from or connected with KantiNotes, including:
- content posted by users, and any reliance on it;
- the loss or corruption of data, including your content;
- interruptions, errors, delays, or the suspension or discontinuation of KantiNotes;
- unauthorised access to our systems or your account;
- other users' behaviour, on KantiNotes or elsewhere;
- indirect or consequential damage, and lost grades, time or opportunities.
This does not exclude liability that cannot be excluded under mandatory law, in particular for damage we cause intentionally or through gross negligence.
12. Claims caused by you
If someone makes a claim against us because of your content, or because you broke these terms or the law, you must compensate us for the resulting costs and damage, including reasonable legal costs, to the extent permitted by law.
13. Ending your use
You can stop using KantiNotes and delete your account at any time in the app (Settings → delete account). We may suspend or close your account at any time and for any reason, in particular if you break these terms, with or without notice. Sections 4 (the exceptions to the end of the licence and your promises), 10, 11, 12, 15 and 16 continue to apply after your account ends.
14. Changes to these terms
We may change these terms. For significant changes, we will tell you in the app or by email at least 14 days before they take effect. Changes needed for legal or security reasons, or that only concern new features, can take effect immediately. If you keep using KantiNotes after a change takes effect, you accept the new terms. If you do not accept them, delete your account.
15. Governing law and courts
These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The courts of the Canton of Solothurn, Switzerland, have jurisdiction, unless mandatory law gives you the right to go to court where you live. If you live in the EU, you also keep the protection of the mandatory consumer law of your country.
16. General
If any part of these terms is invalid, the rest remains in force, and the invalid part is replaced by a valid one that comes as close as possible to its purpose. If we do not enforce a right, we have not given it up. We may transfer KantiNotes and our rights and obligations under these terms to someone else. These terms and the Privacy Policy are the entire agreement between you and us about KantiNotes.
These terms exist in German and English. If the two differ, the German version prevails.
